Question:

355 Mr. Durkan asked the Minister for Social and Family Affairs when carer's allowance will be awarded in the case of a person (details supplied) in County Kerry; and if she will make a statement on the matter. [28153/03]

As the Deputy has been informed in answer to his parliamentary question on 22 October 2003, the person concerned is no longer entitled to carer's allowance as they no longer satisfy the conditions as prescribed in legislation, as the person being cared for is in residential care from Monday until Friday afternoon.

Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
