Question:

89 Ms O'Sullivan asked the Minister for Justice, Equality and Law Reform the reason he has not yet made his promised statement to Dáil Éireann on the report of the Nally inquiry into allegations that the Garda withheld information from their counterparts in Northern Ireland which, it is claimed, might have helped to prevent the Omagh bombing, despite having received the report before the end of August 2003; when he intends to publish the report; when he will make the promised statement on its contents; and if he will make a statement on the matter. As I stated in my reply to Parliamentary Question No. 98 of 15 October 2003, I have sought legal advice in relation to certain issues arising from the report. Unfortunately this matter is complicated by the fact that a person central to the allegations made is facing criminal charges. I am sure the Deputy will appreciate that I do not want to say or do anything which might prejudice those proceedings. I am consulting with the Attorney General and I hope to be in a position shortly to report to the House given the legal constraints I have outlined.
