Question:

138 Mr. Durkan asked the Minister for Justice, Equality and Law Reform if his attention has been drawn to persons deported from this country for failure to comply with emigration procedures or refugees or asylum status who were subsequently imprisoned or otherwise had their human rights interfered with in any way; and if he will make a statement on the matter. The statutory procedures governing deportations are as set out in the Immigration Act 1999, as amended. Section 3(2) of that Act sets out the categories of persons who may be the subject of a deportation order. Aside from the general provision allowing for deportations of non-nationals in the common good and for transfers of persons under the Dublin Convention to other European Union states to have their asylum applications considered there, persons granted refugee status may not be deported nor may persons whose asylum applications are still under consideration. All deportations from the State are subject to the prohibition on refoulementas set out in section 5 of the Refugee Act 1996, as amended.
