162 Mr. G. Mitchell asked the Minister for Justice, Equality and Law Reform if a person, details supplied, in Dublin 8 will be allowed to join their mother in order to complete an education course in Dublin. [28701/03]

The person in question made an application for a study visa in September 2003. The application was refused because it had not been established, on the basis of the documentation supplied to the Department, that the applicant would observe the conditions of the visa. In particular it was felt that the applicant had not displayed sufficient evidence of her obligations to return home following her proposed college course. It was noted on the visa application that the applicant's mother is currently working in the State on foot of a working visa. In addition, although the applicant, a 19 year old, describes herself as a full-time student there is no supporting documentation supplied with the visa application of educational activity since she left secondary school in 2001.

An appeal against the refusal was received, however, the visa appeals officer, having re-examined the application, upheld the original decision to refuse the application.

If a fresh visa application is submitted enclosing documentation addressing the issues raised above, including information as to her educational achievements over the past two and a half years, it will be considered anew.
