Question:

193 Mr. Ring asked the Minister for the Environment Heritage and Local Government the number of councillors who have given up their seats on local authorities, giving details for all town councils, corporations and county councils to date; the cost of this to the State; the amount which has been paid out in total; and the names and addresses of the replacements for the councillors who have given up their seats, under the Local Government (No. 2) Act 2003. [30564/03]

On the basis of information supplied by local authorities to my Department, I understand that 96 councillors who were also Oireachtas Members resigned their local authority membership in the period 4 May to 30 September 2003 and details are set out in the following table. In addition to the early payment of the normal retirement gratuity which would have been available to all councillors next June, the Local Authority Members (Gratuity) (Amendment) Regulations 2003 provide that Oireachtas councillors who retired in the period mentioned are entitled to an additional gratuity of €5,000 in recognition of their departure from local government. The cost of this additional gratuity is estimated at €0.48 million.

The filling of a casual vacancy in a local authority is a matter for the elected council in accordance with section 19 of the Local Government Act 2001. Accordingly, details of members who may have been co-opted to replace retiring Oireachtas councillors are not available in my Department.
