Question:

505 Mr. O'Dowd asked the Minister for Justice, Equality and Law Reform the position regarding a request for long-term residency by a person (details supplied) in County Louth. [30713/03]

An application for residency on the basis of parentage of an Irish born child was received on 22 August 2002 from the person concerned.

Following the decision of the Supreme Court in the cases of L and O, the separate procedure, which then existed to enable persons to apply to reside in the State on the sole basis of parentage of an Irish born child, ended on 19 February 2003. The Government decided that the separate procedure would not apply to cases, which were outstanding on that date. The case to which the Deputy refers is one of those cases. In that context she and her husband were notified on 17 November 2003 that there is no separate process for considering such applications and their documentation was returned to them.

The person concerned has current permission to remain in the State, which was granted on the basis that she is in the employment of an employer who has a work permit in respect of her. This provides the person with a legal basis for remaining in this jurisdiction for the duration of the permission to remain.
