139 Mr. Penrose asked the Tánaiste and Minister for Enterprise, Trade and Employment the position whereby a pension scheme is over-funded, and a redundancy arises, the areas in which the surplus funding is allocated; if there is proposed legislation, to ensure that workers who have contributed, get their share of such surplus funding that might be available in the pension fund; and if she will make a statement on the matter. [31104/03]

The Redundancy Payments Acts 1967 to 2003, which my Department administers, only cover statutory redundancy entitlements and do not extend to the matter of pension schemes and their funding. This would be a matter instead for the Minister for Social and Family Affairs.
