Scrutiny of EU Legislative Proposals: Discussion.

We have a number of new proposals for consideration by the joint committee. I refer members to the separate briefing document. In regard to COM (2009) 431, given the information provided by the Department, it is proposed to note this adopted measure. Is that agreed? Agreed. In regard to COM (2009) 435, given the information provided by the Department, it is proposed to note this adopted measure. Is that agreed? Agreed.

In respect of COM (2009) 460, it is proposed to note this adopted measure. Is that agreed? Agreed. In respect of COM (2009) 468, it is proposed to note the adopted measure. Is that agreed? Agreed. In respect of COM (2009) 474, it is proposed to note the adopted measure. Is that agreed? Agreed. In respect of COM (2009) 493, it is proposed to note the adopted measure. Is that agreed? Agreed. In respect of COM (2009) 496 it is proposed to note the adopted measures. Is that agreed? Agreed.

The next item is COM (2009) 438. Given the information provided by the Department, it is proposed to note the proposal. Is that agreed? Agreed. In regard to COM (2009) 453, given the information provided by the Department, it is proposed to note the measure. Is that agreed? Agreed. It is proposed to note COM (2009) 459. Is that agreed? Agreed. COM (2009) 470 does not warrant further scrutiny. Is that agreed? Agreed.

The next item is COM (2009) 477. Given the information provided by the Department, it is proposed to note the measure. Is that agreed? Agreed. COM (2009) 483 does not warrant further scrutiny. Is that agreed? Agreed. In respect of COM (2009) 498, given the information provided by the Department, it is proposed that the proposal does not warrant further scrutiny. Is that agreed?

COM (2009) 498 refers to a dispute settlement mechanism applicable to disputes under the trade provisions of the Euro-Mediterranean agreement between the European Communities and its members states of the one part and the Republic of Lebanon, of the other part. Have we had an update on the Euro-Mediterranean trade agreement in relation to Israel? Will the Chairman establish if negotiations are taking place?

COM (2009) 498 refers to a proposal for a Council decision on the conclusion of an agreement in the form of a protocol establishing a dispute settlement mechanism applicable to disputes under the trade provisions of the Euro-Mediterranean agreement establishing an association between the European Communities and its member states, of the one part, and the Republic of Lebanon, of the other part. The Deputy wishes to know if there is a similar agreement with Israel?

Yes.

The joint committee went into private session at 12.05 p.m. and resumed in public session at 12.10 p.m.

We will start with COM (2009) 531. The information note states that it does not warrant further scrutiny. COM (2009) 443, COM (2009) 444, COM (2009) 457 — it is proposed to note these proposals where the Commission has adopted its decisions. COM (2009) 588 does not warrant further scrutiny. COM (2009) 602, based on the information note, does not warrant further scrutiny. COM (2009) 610, based on the information note, does not warrant further scrutiny.

COM (2009) 370 was accompanied by an information note from the Department and additional details given about the proposals. It is proposed to note the measure for no further scrutiny and proposals are to be sent for information. COM (2009) 476 — it is proposed to note this and send it to the Joint Committee on Agriculture, Fisheries and Food.

Under item 5 we come to Title V TEU and Title IV TEC measures, with 13381/2/09 REV 2 and RTRC 13382/1/09 REV1. A basic information note proposes that these do not warrant further scrutiny. For COM (2009) 293 and COM (2009) 294, the information note provided by the Department proposes to note these two proposals and send them for information notes to the Joint Committee on Justice, Equality, Defence and Women's Rights, which will probably have the proposals referred to it in future by the Houses in advance of the motion being taken.

COM (2009) 342 and COM (2009) 344 give the information provided by the Department. It is proposed to note these two proposals and to send them for information to the Joint Committee on Justice, Equality, Defence and Women's Rights, which will probably have these referred to it by the Houses in advance of a motion being taken. The committee has asked questions about the level of scrutiny these documents undergo. They may not have been referred to or debated by this committee, or they might arrive too late in front of the Government to have a full debate, something we must look at.

Item 6 concerns early warning notes. On EWN C215-05, given that there are no reported difficulties for Ireland, it is proposed that this trade matter does not warrant further scrutiny. On EWN C215-06, given that there are no reported difficulties for Ireland, it is proposed that this trade matter does not warrant further scrutiny. On EWN C224-10, given that there are no reported difficulties for Ireland, it is proposed that this trade matter does not warrant further scrutiny. On EWN C224-11, given that there are no reported difficulties for Ireland, it is proposed that this trade matter does not warrant further scrutiny. On EWN C240-06, given that there are no reported difficulties for Ireland, it is proposed that this trade matter does not warrant further scrutiny.

There are no proposals under item 7 for further scrutiny, while under item 8, there are no proposals for forwarding to sectoral committees.

Under item 9, COM (2009) 553, proposal for a Council regulation fixing for the 2010 the fishing opportunities for certain fish stocks and groups of fish stocks applicable in Community waters and for the Community vessels in waters where catch limitations are required. Given the information note provided by the Department on the importance of the proposal for the Irish fishing industry, it is proposed to forward the proposal to the Joint Committee on Agriculture, Fisheries and Food for further scrutiny and to the Joint Committee on European Affairs for information. It will be open to the Joint Committee on Agriculture, Fisheries and Food to look at the proposal in more detail through written contact with the Department and stakeholders or by inviting the Minister to another meeting.
