SECTION 32.

Question proposed: "That section 32 stand part of the Bill."

Section 32 is a new provision. It empowers the official assignee where a member of a partnership is adjudicated to require the solvent partner to supply him with any accounts or information which he may require relating to the partnership property and the bankrupt's interest in it.

The committee recommended the enactment of this section because, although the solvent partner is bound to give the court and the official assignee all accounts and information regarding the partnership's estate which they may require, difficulty had been experienced by the official assignee in obtaining such information. If the bankrupt's interest in a solvent partnership can be promptly determined to the satisfaction of the official assignee, the winding up of the partnership by the Court may be unnecessary. When the accounts and information required by the section are delivered to the official assignee he can then decide whether an application should be made under section 133 to wind up the partnership.
