SECTION 62.

Question proposed: "That section 62 stand part of the Bill."

This section sets out the various duties of the bankruptcy inspector and his assistants. The bankruptcy inspector is the new name give to the court messenger. The duties listed in section 62 include all those carried out by the messenger or his assistants under existing law. For example, section 27 empowers the bankruptcy inspector and his assistants acting under warrant of the court to seize the bankrupt's property and for that purpose to break open any house or place where he or his property is reputed to be. Section 100 empowers the court to order that the property of arranging debtors should be possessed and received by the Official Assignee. One of the bankruptcy inspector's duties will be to take possession and to take an inventory of such property. It is a re-statement of the existing position except that the court messenger will now be titled the bankruptcy inspector.
