PRIVATE BUSINESS. - DUN LAOGHAIRE, BLACKROCK, DALKEY CORPORATION BILL, 1924.

AN CATHAOIRLEACH

There is a report from the Joint Committee on Standing Orders dated 8th July intimating that no notice of appeal from the report of the Examiner of Private Bills in the case of Dun Laoghaire, Blackrock, Dalkey Corporation Bill, 1924, has been received within the prescribed time, and that the Bill is accordingly deemed to have been read a first time in the Seanad.

There is no action required on that. I am in a difficulty about the Second Stage, because under the Standing Orders it is necessary to move formally the Second Stage. At the same time I wish to move the postponement of the Second Stage until October next, and I will briefly explain the position. The Standing Orders provide a certain limit of time in which the Second Stage must be moved. Of course, as the members of the Seanad understand, I act on behalf of the promoters in moving the Second Stage. It is clearly desirable, and the promoters have definitely asked me, to move that this Bill be postponed until October, owing to the fact that the Government have appointed a Commission on local administration in Dublin City and County, and it is, I think, hardly desirable to go on with a Bill of this character until we know a little more as to what action that Commission is to take. I beg formally to move that in view of the appointment of a Commission on local administration in Dublin City and County, that the Second Reading of the Dun Laoghaire, Blackrock, Dalkey Corporation Bill, 1924, be postponed to Wednesday, 22nd October next, or, if the Seanad be not sitting on that day, on the next day thereafter on which the Seanad shall so sit.

AN CATHAOIRLEACH

Would it not be more in order, Senator, to move the Second Reading and then leave it to some other Senator to move the postponement of the Second Reading until the date you fix?

If that is possible I am quite agreeable. It is one of those cases which have arisen for which there is no proper provision. I am really acting on behalf of the promoters, but I am obliged to act in both capacities. I suggest that the Seanad allow me to move formally the Second Reading and then the postponement of the Second Reading.

AN CATHAOIRLEACH

We will take it that the Second Reading of the Bill has been formally moved, and now I will receive a motion from you that further consideration of the Bill be adjourned until the 22nd October.

I am somewhat in a difficulty about this, for the reason that I intended to oppose the Second Reading of the Bill, and I do not know what position this will leave us in, whether we will be compelled to take the second stage on that day or not.

I understand the Seanad will be in exactly the same position as it is to-day when the second stage is again taken.

AN CATHAOIRLEACH

It will not prejudice your rights at all, Senator Farren. We are not giving it a Second Reading to-day. In any event I shall see that your position is not prejudiced in any way.

I am satisfied.
