Notice of Motion-Military Tribunal Sentence.

On last Saturday, Sir, I handed in the following notice of motion for next Wednesday:—

That the Seanad is of opinion that a grave miscarriage of justice has occurred in the case of Captain P. Hughes sentenced on 1st instant by the Constitution (Special Powers) Tribunal to two years' imprisonment and requests the Government in pursuance of their powers under the Constitution Amendment Act No. 17 to order his immediate release.

Last night a decision was taken to initiate legal proceedings in this case. Therefore, by next Wednesday the matter, probably, will be sub judice. Accordingly, I ask leave of the House to withdraw the motion.

I saw the notice of motion referred to and I think that possibly I would have had to rule it out of order in any case.
