Seanad Éireann debate -
Wednesday, 15 Dec 1954

Vol. 44 No. 6

National Monuments (Amendment) Bill, 1954—Fourth and Fifth Stages.

Government amendment:—
In page 5, Section 18, to delete "common" where it occurs in lines 43 and 47.

This amendment and the following amendment arise in the same way. The House will remember that the State Property Bill and the National Monuments Bill were both before the two Houses of the Oireachtas at the same time. When we were drafting the Bills, we were not in a position to know which Bill would go through first and we therefore had to provide in both Bills for judicial notice of the seal of the Commissioners of Public Works. The State Property Bill having been enacted and, in Section 23, having provided judicial notice for the seal of the Commissioners of Public Works, it is accordingly unnecessary now to provide in this Bill also for the same thing. I am, therefore, asking the Seanad to agree to these two verbal deletions: in one case, the deletion of the word "common"—the seal was described in one place as a common seal, and, in the State Property Bill and other legislation, it is described as the seal, and it is better that the same wording should be used here—and in the other, the deletion of the provision by virtue of which the seal of the Commissioners of Public Works will be judicially noticed, because, in fact, that has been provided by the State Property Bill passed here at the last sitting.

Amendment put and agreed to.
The following Government amendment was also agreed to:—
In page 5, Section 18, to delete sub-section (3).
Bill received for final consideration and passed.
