Vol. 48 No. 10

Destructive Insects and Pests (Consolidation) Bill, 1957. - Garda Síochána Pensions Order, 1957—Motion of Approval.

I move:—

That the Seanad hereby approves of the Garda Síochána Pensions Order, 1957, made on the 8th day of November, 1957, by the Minister for Justice, with the sanction of the Minister for Finance, under Section 13 of the Police Forces Amalgamation Act, 1925.

The Garda Síochána Pensions Order, 1957, which I am asking the House to approve is linked up with the Pensions (Increase) Act, 1956. As Senators are aware, that Act provided for increases in pensions of State servants who had retired prior to 1st November, 1952. When the provisions of the Act came to be applied to a particular ex-superintendent of the Garda Síochána who had retired in 1951 and who was also in receipt of an Army pension, it was found that the aggregate of his dual pensions was held, under existing Pensions Orders, to a limit of two-thirds of his Garda retiring pay. No provision was made in the 1956 Act to raise this limit to two-thirds of his notional pay on the 1st November, 1952, which would give him a pension increase in conformity with that given to other State servants. The purpose of the present Order is to repair that omission.

Question put and agreed to.
The Seanad adjourned at 9.45 p.m. until 3 p.m. on Wednesday, 4th December, 1957.
