Resignation and Appointment of Ministers.

Fuarthas scéala ó Roinn an Taoisigh á chur in iúl:

(1) go raibh an tUachtarán, ag gníomhú dó ar chomhairle an Taoisigh, tar éis glacadh de bhun Airteagal 28.9.3º den Bhunreacht le Pádraig Mac Gabhann d'éirí as oifig mar chomhalta den Rialtas;

(2) go raibh an Taoiseach, i bhfeidhmiú na gcumhachtaí a thugtar dó le halt 4 den Acht Airí agus Rúnaithe (Leasú), 1946, tar éis (a) sannadh na Roinne Dlí agus Cirt do Chathal Ó hEochaidh a fhoirceannadh agus an Roinn sin a shannadh dó féin, agus (b) an Roinn Talmhaíochta a shannadh do Chathal Ó hEochaidh, comhalta den Rialtas, le héifeacht, i ngach cás, ón 8 Deireadh Fómhair, 1964;

(3) go raibh an tUachtarán ar ainmniú an Taoisigh, le comhaontú Dháil Éireann roimh ré, tar éis Brian Ó Luineacháin, comhalta de Dháil Éireann, a cheapadh ar an 3 Samhain, 1964, de bhun Airteagal 13.1.2º den Bhunreacht, chun bheith ina chomhalta den Rialtas; agus

(4) go raibh an Taoiseach, ar an 3 Samhain, 1964, i bhfeidhmiú na gcumhachtaí a thugtar dó le halt 4 den Acht Airí agus Rúnaithe (Leasú), 1946, tar éis sannadh na Roinne Dlí agus Cirt dó féin a fhoirceannadh agus an Roinn sin a shannadh do Bhrian Ó Luineacháin comhalta den Rialtas.

Communications have been received from the Department of the Taoiseach stating that:—

(1) the President, acting on the advice of the Taoiseach, had accepted in pursuance of Article 28.9.3º of the Constitution, the resignation of Patrick Smith as a member of the Government;

(2) the Taoiseach, in exercise of the powers conferred on him by section 4 of the Ministers and Secretaries (Amendment) Act, 1946, (a) had terminated the assignment of the Department of Justice to Charles Haughey and had assigned that Department to himself, and (b) had assigned the Department of Agriculture to Charles Haughey, a member of the Government, with effect, in each case, from the 8th October, 1964;

(3) the President, on the nomination of the Taoiseach, with the previous approval of Dáil Éireann, had appointed, on the 3rd November, 1964, in pursuance of Article 13.1.2º of the Constitution, Brian Joseph Lenihan, a member of Dáil Éireann, to be a member of the Government; and

(4) the Taoiseach, in exercise of the powers conferred on him by section 4 of the Ministers and Secretaries, (Amendment) Act, 1946, had, on the 3rd November, 1964, terminated the assignment of the Department of Justice to himself and had assigned that Department to Brian Joseph Lenihan, a member of the Government.
