Seanad Éireann debate -
Thursday, 16 Jul 1992

Vol. 133 No. 20

Request under Standing Order 29.

In accordance with Standing Order 29, I request leave to move the Adjournment of the Seanad to discuss a specific and important matter of public interest requiring urgent consideration, that matter being the appalling decision of the courts yesterday to release a person who pleaded guilty to the charge of rape. I express my deep concern for the consequences of that decision. I also wonder how the victim of that appalling crime and the victims of all crimes must feel.

An Leas-Chathaoirleach

The Senator cannot elaborate on that matter.

We in the House have a responsibility in this regard. It is clear that wrong has been done.

An Leas-Chathaoirleach

I have not had an opportunity to give a decision yet.

We have a duty to the innocent victims of this particular crime. I feel that this matter requires urgent attention.

An Leas-Chathaoirleach

Would the Senator please wait until the Chair gives a decision on his request?

We are the makers of legislation and surely we must have an input into what the consequences of such legislation must be.

An Leas-Chathaoirleach

I must ask the Senator to resume his seat.

We must use every means at our disposal to ensure that this appalling decision is reversed.

An Leas-Chathaoirleach

Having given careful consideration to the matter, I cannot consider it to be one contemplated by Standing Order 29. I therefore regret that I have to rule the matter out of order.

I very much resent that decision. It is my opinion that this is a matter of urgent importance.

An Leas-Chathaoirleach

It is a matter for the courts, Senator, not for this House.
