Planning and Development Regulations, 2001: Motion.

I move:

That Seanad Éireann approves the Planning and Development Regulations, 2001, copies of which, in draft, were laid before Seanad Éireann on 7 December 2001.

Question put and agreed to.

We move on to item 2, Transport (Railway Infrastructure) Bill, 2001.

Item No. 1 was without debate.

The Order of Business was agreed. I read the motion which was item No. 1. I asked the Leader to move the motion and it was put and agreed.

The House was not in order. We had not heard it and we are opposed to it.

The House was in order.

We are opposed to the motion.

The motion was agreed.

It was not done with the knowledge of the House, although maybe with the knowledge of the Leader.

That is not my fault, Senator. I read the motion, asked the Leader to move it, put the motion to the House and asked if it was agreed. As there was no dissenting voice I declared the motion carried. I am moving on to No. 2.

I want to raise a point of order. Order had not resumed in the House as the Chair did not ring the bell. A number of people were still on their feet in the Chamber talking and it was not heard by a number of us. This motion is a fundamental breach of basic democratic—

It was agreed by the House that this motion would be taken without debate. The motion has been disposed of.
