Suspension of Member: Motion

I move:

That, having regard to the Report of the Committee on Members' Interests of the results of an investigation into a complaint concerning Senator Ivor Callely, which report was laid before Seanad Éireann on 14th July, 2010 and, in particular, having regard to the findings and determinations of the Committee contained in that Report, Senator Ivor Callely, notwithstanding anything in Standing Orders, be censured and that he be suspended from the service of the House for the period of 20 days on which the House shall sit and that such annual sum by way of salary payable to Senator Callely under the Oireachtas (Allowances to Members) Act 1938 be withheld for that period and that the period of that suspension shall commence forthwith.

In support of the motion and on behalf of Fine Gael Senators, I welcome this report. The Committee on Members' Interests of Seanad Éireann has done very good work and has acted expeditiously. This was an issue that did damage to the House and it is important that it was dealt with quickly and decisively which is what the committee did. It also took a decision on grounds that are sustainable.

It is also important that for the first time in many years Members are prepared to hold their own colleagues to account. What will come as a surprise to people, however, is that the penalty of suspension is as far as this committee and the House can go. There is an issue of the repayment of moneys which were claimed in expenses and deemed inappropriate. In this case, it was an intentional act, grave and serious and not in good faith. Furthermore, for a lot less, people are amenable to the courts.

Accordingly, the issue of repayment should be addressed. The other authorities which are appraised of this case, the committee's report and the decision of this House should follow up on this matter. The committee has done good work and there is no hesitation on this side of the House in supporting this motion.
