The origin of the section is contained in the Sale of Goods and Supply of Services Act, 1980. In the intervening 14 years or so, the EU open market has become operative with the dismantling of barriers and so on. Presumably, therefore, EU directives are being transposed in different countries regarding the same issues. In this respect the section is out of date in the context of developments on consumer protection within the EU.
