SECTION 109.

Amendment No. 278 has been discussed with amendment No. 269.

I move amendment No. 278:

In page 59, line 10, before "a statement" to insert "the mortgage agent shall ensure that".

Question proposed: "That section 109, as amended, stand part of the Bill".

This is a reasonable section, although it is slightly intriguing to see how it will gel with whatever is the reformed version of section 108. It might be prudent if we resubmit this section together with section 108. We might want to discuss it in this committee if there is a knock-on effect from section 108 to this section. However, as it stands, it seems reasonable.

Are other sections consequential on section 108? If that is the case, we will have an awkward situation.

No; that section stands alone.

Is Deputy Bruton suggesting that we also defer consideration of section 109? We have discussed the amendment.

This section deals with fees payable by an applicant. The other sections deal with disclosures of commission and charges.

This section deals with fees. Therefore, they are separate.

I am happy with the section. Can the Minister assure us that the provisions in section 109 are not somewhat flawed?

I can give the Deputy that assurance.
