SECTION 115.

Amendment No. 287 not moved.

I move amendment No. 288:

In page 61, subsection (1), line 21, to delete "creditor" and substitute "person".

The purpose of the amendment is to broaden the scope of the section so as to encompass any person who may issue a proposal form or application form used in connection with the agreement, the provisions of which might require the consumer to indicate positively that he does not wish to purchase any goods or avail of any service in relation to the agreement. Its purpose, therefore is to provide greater protection for the consumer to the use of inertia selling provisions.

Amendment agreed to.

I move amendment No. 288a:

In page 61, subsection (1), line 21, after "agreement" to insert "or consumer hire agreement".

This amendment extends the scope of section 115 to consumer hire agreements. A person is restricted from using inertia selling provisions in credit agreements and now to consumer hire agreements. The difference between those two types of agreements was pointed out earlier.

Amendment agreed to.
Section 115, as amended, agreed to.
