I move amendment No. 1:

In page 4, subsection (3), line 21, after "operation" to insert "not earlier than three months after the passing of the Act".

The travel trade would require at least that period of time to enable it to comply with the extensive requirements of this Bill, particularly in relation to the necessary financial security provisions — which can be complicated — that must be arranged. The Minister indicated that time can be provided by way of regulation. However, that is no guarantee that the required length of time will be given. I hope the Minister will accept the amendment.

A number of important aspects must be balanced. The main purpose of the Bill is to transpose an EU Directive into Irish law, which should have been done two years ago, as pointed out by a number of Deputies on Second Stage. It is important to give consumers the protection afforded by the Bill as soon as possible.

On the other hand, I accept that the travel trade must be given adequate time to prepare matters such as the accuracy of brochures, etc. The travel trade knows this Bill is being passed and is making the necessary preparations. It is important that it should have adequate time to prepare for the new requirements under the legislation. I do not accept the necessity for the amendment. This issue does not require an amendment to the Bill as it refers to the timing of the commencement order bringing the Bill into operation. Section 1 of the Bill is in accordance with standard practice whereby the Minister makes an order to bring the section into operation.

This amendment is linked with amendment No. 9 which refers to section 10. I will say more on the matter at that stage. All that is required is an order and the Minister has discretion in that regard. I guarantee the House that, in consultation with the travel trade, I will ensure it is given adequate time and I will balance that with the need to implement the legislation.

It would be helpful if the Minister would guarantee that there would be a period of three months.

This will be done in consultation with the travel trade and the trade might not say that there is a need for three months. If it assures me that it can be prepared in two months we should implement the protections afforded to the public by this Bill as quickly as possible. I ask the Deputy to accept my bona fide in this matter. I will not do anything to damage the trade or to make it impossible for its members to operate.

I understand that the trade is seeking a three months delay following the passing of the Bill.

Three months was mentioned when we met them. However, the Bill might not be passed for a long time — it depends on the length of deliberation and when it goes through the next Stages. The length of additional time the trade will need to put its house in order depends on when the Bill becomes law.

Is the Minister saying that he will give the trade as much time as it requires?

Yes, within reason. I found its members very reasonable.

Three months would not be unreasonable?

No. Three months is not unreasonable but we do not need to amend the Bill to that effect.

Will the Minister indicate clearly that there is no intention to bring the Bill into operation without first consulting the trade and that a reasonable length of time — about three months — will be given? Is the Minister giving that assurance?

I gave the Deputy that assurance.
