SECTION 17.

Question proposed: "That section 17 stand part of the Bill."

Will the Minister explain the effect of this section?

Section 17 provides that powers applicable under sections 263 and 264 of the Fisheries Consolidation Act, 1959, in regard to the making of regulations or recruitment of people for fishery protection purposes relative to oyster fisheries will continue to apply as appropriate to licensed operations. This provision is re-enacted from the 1980 Act. It provides that the powers available under sections 263 and 264 of the Fisheries Consolidation Act, 1959, will continue to apply as appropriate to licensed operations.

Are existing licences being excluded from the provisions in this Bill?

Existing licences will remain valid under this Bill.

Some in fish operations may not have a legal licence as determined by the High Court and under the provisions of this Bill they will be legalised. Will the Minister clarify that point? It does not relate specifically to oyster fisheries but the same principle applies.

This section applies only to oyster fisheries.
