SECTION 76.

Amendments Nos. 43 and 44 are related and may be taken together.

I move amendment No. 43:

In page 37, line 40. to delete "avoidance" and substitute "removal".

Ownership of stock cultivated under licence was a grey area. It was always presumed that ownership was vested in the licensee. The "removal" rather than the "avoidance" of doubt is considered a more appropriate description.

With regard to amendment No. 44, it is not the intention of the section that ownership of produce would always vest in the licensee as this would preclude, for example, ownership transfer following sale. This amendment addresses that point.

I move amendment No. 44:

In page 37, between lines 43 and 44, to insert the following subsection:

"(2) Nothing in subsection (1) prevents a licensee from transferring or otherwise disposing of the ownership of any fish or aquatic plants referred to in that subsection.".
