SECTION 75.

I move amendment No. 102:

In page 59, subsection (1)(f), line 22, to delete "(excluding employees)" and substitute "(excluding any person who is an officer solely by virtue of being an employee)".

Section 75(1) requires every credit union to keep a register of members and officers at its registered office. Subsection 75(1)(f) describes the information which should be included in the register of officers of the credit union, excluding employees. As with section 68(1), employees of the credit union may sometimes be appointed to posts such as credit officer or credit control officer and, in such circumstances, it has been represented to me that these employees should have their names, addresses etc. listed in the register.

Following consultation with the parliamentary draftsman the amendment has been prepared. It clarifies that the exclusion only relates to employees who perform no other function. I commend the amendment.

I move amendment No. 103:

In page 59, subsection (4), lines 45 and 46, to delete "in documentary form".

Section 75(4) requires every credit union to keep a duplicate register in documentary form at a place other than its registered office. It has been pointed out to me by various credit union interests that the requirement to keep the register in documentary form is outdated and ignores the practice of many credit unions of keeping duplicate registers on disc or other computer media. I have accepted this and this amendment proposes to delete the words "in documentary form" from the existing subsection.
