SECTION 50.

I move amendment No. 189:

In page 70, subsection (1), line 21, to delete "may" and substitute "shall".

The Minister accepted my amendment to section 15(6) when I made a strong case for local authorities to have the power to charge fees for various services. It applies to local authorities in relation to the granting of waste collection permits. This Bill will impose significant extra costs on local authorities in the processing of applications and in the monitoring of various sections of the Bill. Extra personnel, expertise and resources are required to ensure that the high standards set out in this Bill are fully met by local authorities and by the private sector. I know the Minister has made a commitment to ensure that funds will be made available. However, we are all aware of the current discussions on the Estimates. Local authorities are not always sure that a Minister will be able to give them the money required. "May" should be changed to "shall", particularly in relation to local authorities and the agency. I ask the Minister to accept the amendment.
