SECTION 65.

Amendments Nos. 53 to 55, inclusive, are related and may be discussed together by agreement. Is that agreed? Agreed.

I move amendment No. 53:

In page 41, lines 25 to 30, to delete subsection (1) and substitute the following:

"(1) Subject to the provisions of this section, the publisher of any material to which this section applies shall, within one month after its publication, deliver at his or her own expense, a copy of the material—

(a) to the Board of the Library, or

(b) if the Library establishment day falls after the expiration of the period aforesaid, to the Minister,

and the Board or the Minister, as the case may be, shall, as soon as may be after such delivery, give a written receipt to the publisher for material so delivered.".

Amendments Nos. 53, 54 and 55 deal with mandatory deposit provisions in the interim period before the library board is established. They are technical amendments to permit the Minister to activate the extended mandatory deposit provisions, if wished, pending the establishment of the board of the library. There will be a time lag following the enactment of the Bill before the board is formally established. The amendments are designed to dispose of anything untoward occurring in the vacuum between enactment and establishment.

It is only fair to signal to Opposition spokespersons that I intend to table amendments on Report Stage in connection with sections 65 and 66 to make it clear that the provision which widens the definition of "publisher"— set out in paragraph (b) of the definition — will only apply in respect of the National Library rather than all the institutions listed in the 1963 Act. This will also only apply if the library requests such material.

I move amendment No. 54:

In page 41, subsection (2), to delete lines 31 and 32 and substitute the following:

"(2) The Board, with the consent of the Minister, or, before the Library establishment day, the Minister, may make such regulations as the Board or the Minister, as the case may be, considers appropriate in relation to".

Amendment agreed to.

I move amendment No. 55:

In page 41, subsection (3), line 41, after "Minister" to insert " or, before the Library establishment day, by the Minister".

Amendment agreed to.

I move amendment No. 56:

In page 42, subsection (3)(b), line 12, to delete "section of the public" and substitute "section of the public, and any cognate words shall be construed accordingly".

This is a technical amendment which ensures that words related to the "publisher"— for example, "publish"— will be defined in the same manner.
