SECTION 62.

I move amendment No. 52:

In page 40, subsection (1), line 19, after "Commissioners" to insert "or the Minister, as the case may be,".

This amendment received the majority of the media attention when the Bill was first introduced. Therefore, I propose to be proportionate and say very little about it except to state that it deals with liquor and licences.

The amendment extends the ownership criteria for a premises for which certain listed institutions can obtain liquor on-licences to those vested in the Minister for Arts, Culture and the Gaeltacht as well as the Commissioners of Public Works. The Bill envisages that the only premises for which such licences would be granted would be those vested in the State. While currently where the institutions concerned occupy State owned premises, these premises are vested in the Commissioners of Public Works. Certain other State properties are vested in a Minister and it is not envisaged, at this stage, that there would be any change in this arrangement. However, it is considered desirable to allow for the possibility that, at some stage in the future, some of the State owned premises occupied by the relevant institutions might be vested in the Minister. I will propose additional minor adjustments by way of amendment on Report Stage.
