SECTION 54.

I move amendment No. 106:

In page 34, line 31, after "occupation" to insert "or where the alleged discrimination took place".

Perhaps the Minister could clarify if a case can be taken under section 54 in the area where the discrimination took place.

The present provision dealing with the jurisdiction of the Circuit Court or District Court in matters under this legislation is related to the place of residence or business of the respondent. There are similar provisions in the Employment Equality Bill. I am not sure what function will be served by elaborating on the court jurisdiction in the matter proposed. The proposed amendment could create confusion and would represent an unjustified divergence from the Employment Equality Bill. The District Court's main functions under this Bill relate to discriminatory clubs and the court jurisdiction provided for is intended to dovetail with the licensing Acts. While Deputy McDaid may have in mind the convenience of persons claiming discrimination, the primary redress mechanism under the Bill via the director and the Circuit Court is not a redress mechanism for any aspect of the Bill.
