SECTION 86.

Question proposed : " That Section 86 stand part of the Bill ".

This is much the same as Section 92 of the 1908 Act dealing with the duties of a company in relation to the issue of certificates.

NEW SECTION.

I move amendment No. 29 :

Before Section 87 to insert a new section as follows :

" (1) A certificate under the common seal of the company specifying any shares held by any member shall be prima facie evidence of the title of the member to the shares.

(2) The production to a company of any document which is by law sufficient evidence of probate of the will or letters of administration of the estate of a deceased person having been granted to some person shall be accepted by the company, notwithstanding anything in its articles, as sufficient evidence of the grant."

This is a drafting amendment. Later on we propose to insert a new section and the purpose of this amendment is to amalgamate Sections 87 and 88, as they appear in the Bill, in order to avoid subsequent renumbering.

I just want to say that my point on the earlier section is clarified by this section.

Then the Deputy had not done his homework, as Deputy MacEntee says so often at the Health Committee.

Amendment No. 29 involves the deletion of Sections 87 and 88 and their incorporation in one Section 87.

Sections 87 and 88 deleted.
