SECTION 103.

I move amendment No. 41 :

To delete subsection (2).

Amendment No. 41 is consequential on amendment No. 42. I suggest that amendments Nos. 41 and 42 to taken together.

Yes. Amendment No. 42 re-enacts the subsection (2) deleted by amendment No. 41—the purpose being in this case to preserve the continuity of numbering of sections.

NEW SECTION.

I move amendment No. 42 :

Before section 104 to insert a new section as follows:

" The registrar shall give a certificate under his hand of the registration of any charge registered in pursuance of this Part, stating the amount thereby secured, and the certificate shall be conclusive evidence that the requirements of this Part as to registration have been complied with."

This deletes the section. Again, we took counsel from the Jenkins Report and decided to delete the section because we thought it did not serve any useful purpose and only added unnecessarily to the obligations of the company.

What is the section in the old Act that Section 104 is the equivalent of?

Section 93 subsection (6) and Section 99 subsection (3).

Quite apart from the Jenkins Report, does not this also follow from the fact that you are lodging only particulars and not the instruments any more?

Not necessarily in this case, I understand.

I see. I thought it would have.
