SECTION 289.

I move amendment No. 88 :

In subsection (1), paragraph (d), page 150, line 32, to delete " wife " and substitute " spouse ".

This is a simple amendment to substitute the word " spouse " for the word " wife ".

To cover both sexes ?

Yes. I understand the possessive adjective " his " also means " hers ".

Whatever about the interpretation in this context, I think the marriage ceremony makes that clear.

Amendment agreed to.
Question proposed : " That Section 289, as amended, stand part of the Bill."

This is also a new section. It was recommended by the Company Law Reform Committee and it is designed to deal with a method of evading Section 212 of the 1908 Act.

In other words, the assets could be transferred out of the company in advance of winding up. Is that not what you want to avoid ?

That is right. This range of sections deals with that sort of thing.
