SECTION 343.

Question proposed: " That Section 343 stand part of the Bill."

This is the same as Section 266 of the old Act.

NEW SECTION.

I move amendment No. 108:

Before Section 344 to insert a new section as follows:

" For the purposes of this Part, ‘ unregistered company ' shall include any trustee savings bank certified under the Trustee Savings Banks Acts, 1863 to 1958, any partnership, whether limited or not, any association and any company with the following exceptions—

(a) a company as defined by Section 2;

(b) a partnership, association or company which consists of less than eight members and is not formed outside the State."

As at present drafted, Section 344 would not enable our courts to wind up companies which are British or Six County companies registered before 6th December, 1921. That is obviously wrong, and it is desirable that there should be power to wind up such companies.

Acceptance of this amendment involves the deletion of Section 344 of the Bill.
