Special Committee Companies Bill, 1962 debate -
Wednesday, 20 Nov 1963

SECTION 190.

I move amendment No. 2 :

In subsection (11), page 110, paragraph (c), subparagraph (ii) to delete " is " in line 58 and substitute " or his spouse or any child of his or any person or persons holding in trust for him or them or any of them are ".

I set out this amendment because I was afraid there might be a loophole in the subsection.

I have taken some advice on the Senator's amendment and I am told that it is not necessary to repeat the words quoted by the Senator in his amendment. If the Senator would look back to subsection (1) of Section 190, in lines 43 to 45, he will see the words " shares or debentures which are held by, or in trust for, him or his spouse or any child of his or of which he or they have any right to become the holder ". I am advised that the word " person " in the first line of subparagraph (c) of subsection (11) includes all these words. Therefore, there is no need to repeat the degree of relationship in subparagraph (c).

Amendment, by leave, withdrawn.
Section 190 agreed to.
Sections 191 to 193, inclusive, agreed to.
