Special Committee Companies Bill, 1962 debate -
Wednesday, 20 Nov 1963

SECTION 195.

Question proposed : "That Section 195 stand part of the Bill."

In subsection (2) (e) would the Minister consider that instead of the word " any " the word " all " should be substituted ? I am sure this will meet with administrative difficulties having regard to the great number of lists of directorships. I think it is highly desirable that directorships in other companies can be seen in certain circumstances. I do not know whether it is wise or practical to put in all directorships. It will cause a lot of nuisance because it will mean that all companies will have to ask all other companies what their directorships are. I think in principle it seems to be desirable that all directorships should be shown.

Whether they are incorporated in the State or not ?

I think we must restrict it to the State.

We could not go outside it. Subparagraph (e) of subsection (2) is intended to cover all of the directorships. We were advised that the use of the word " any " embraces all of the directorships.

I think the Minister is correct but I have doubts whether it is clear and whether the Registrar will take action. I think it would make it absolutely clear if you put the word " all " instead of " any ".

I am all for simplicity and clarity. Does the committee agree ?

Subject to what the draftsman says.

Would the Committee permit me to ask the draftsman about it before making any amendment because a change of a word like that might lead to complications ?

Question put and agreed to.
