Special Committee Defence Bill, 1951 debate -
Wednesday, 30 Apr 1952

SECTION 250.

I move amendment No. 286 :—

In line 59, after " months ", to add " or to a fine not exceeding £20 or to both such imprisonment and such fine ".

It is not necessary to say very much on this amendment because I have the feeling that the Minister will accept it. The section provides that a recruit who gives a false answer to any question in an attestation paper will be brought before a district court and sentenced to imprisonment for any term not exceeding three months. To that I want to add " or to a fine not exceeding £20 or to both such imprisonment and such fine ". It is designed to give a district justice discretion in proper cases to impose a fine.

This is not only reasonable but desirable, for the reason that there is less temptation to a district justice to find an excuse for letting a man go completely.

I will have the suggestion examined in the light of what has been said.

Amendment, by leave, withdrawn.
Section 250 agreed to.
