SECTION 278.

Question proposed : " That Section 278 stand part of the Bill."

I want to get an explanation. This says that one shall deposit copies of the by-laws " in every Circuit Court office " in the area. Why Circuit Court office ?

I assume these offices are considered the most convenient places. This is a repetition of Section 12 of the Act of 1949, which provides for the giving of advance publicity to by-laws so as to enable an objection to be lodged.

Why Circuit Court ?

District Court would be better.

The ideal thing would be the Garda barracks.

I think the Garda barracks would be the proper place.

The Circuit Court office is in the county town of each county.

It could be lodged with the District Court clerk.

There may be several District Court clerks in the county area. There is only one Circuit Court office and it is in the county town.

That might be miles from the area. The Garda barracks might be better.

Should it not be in the county council office ? It does not matter very much.

This seems to have given rise to no difficulty since 1949.

SECTION 288.

I move amendment No. 310 :—

To delete sub-section (1) and substitute the following sub-section :—

" (1) The provisions of this Act (except this Part and Sections 8, 103, 104, 232, 233 and 234 and Part VI) shall not, save where specific mention is made therein to the Army Nursing Service or save as is provided by an order under this section, apply in respect of members of the Army Nursing Service."

This is a purely textual amendment. It proposes to insert a new sub-section (1) for the existing one. The effect of the sub-section is that while members of the Army Nursing Service become formally members of the Defence Forces, the Act does not apply to them, except for certain sections.

There are some important definitions in Section 291, and I think the Committee should pause.

I read them, and I think they are all right.

It is an important section.
