SECTION 100.

Question proposed : " That Section 100 stand part of the Bill."

Sub-section (2) of Section 100 provides for the possibility of a fine being imposed on an employer, part of the fine being paid for the benefit of the family of the deceased or injured worker. What occurred to me was the need for putting in some proviso to make it clear that that subsection does not prejudice whatever right an employee may have against an employer under any other enactment. I presume an employee injured in circumstances where criminal negligence could be proven against an employer, could proceed for damages inindependently of any provision of this Bill.

This is really a reenactment of a provision in the 1901 Act, and we will look at that aspect of the matter and see if it is clear whether the right of action lies independently of this section.
