SECTION 12.

Question proposed : " That section 12 stand part of the Bill."

The courts make the specification in relation to specified particulars as to his earnings. Would the Minister envisage a statement in writing, or would that require a form to be completed.

Forms will be drafted.

May I make a particular recommendation here? I do not want to go back on the definition of a section but I think that the Minister should specifically in any such forms include gross earnings and indeed net earnings if possible and such particulars as PAYE numbers and particularly social welfare numbers. If the social welfare number is also included and there is no reference to it here there might be circumstances, say a wife in receipt of a deserted wife's benefit allowance or a maintenance order where one would want to ensure the court order would not be proceeded with while she was also in receipt of other parallel social welfare benefits. The point in regard to gross earning is very important because many such women who are the offended parties may just not be aware of the gross earnings of their husbands. I think gross earnings is very important.

I will arrange to have the Deputy's remarks borne in mind by the parliamentary draftsman.
