SECTION 12.

(1) This Act may be cited as the Legitimacy Act, 1930.
(2) This Act shall come into operation on 31st day of July, 1930.

In Section 12 the date will have to be changed. The Section as it stands reads: " . . . This Act shall come into operation on 31st day of July, 1930." You will have to make that 1st day of January, 1931.

Will it be possible to have the Report printed and the Bill passed through both Houses before that date?

If that date is too early perhaps we could fix the 1st day of March, 1931.

That would probably be a better date. We have to consider the time it will take to get the Report printed. Then the Bill has to come before both the Dáil and the Seanad.

I move:—

In Section 12, line 51, to delete the words " on 31st day of July, 1930," and substitute the words " on 1st day of March, 1931."

SCHEDULE.
1.—The Registrar-General may, on production of such evidence as appears to him to be satisfactory, authorise at any time the re-registration of the birth of a legitimated person whose birth is already registered under the Births and Deaths Registration Acts, 1863 to 1880, and such re-registration shall be effected in such manner and at such place as the Registrar-General may by regulation prescribe:
Provided that the Registrar-General shall not authorise the re-registration of the birth of any such person in any case where information with a view to obtaining such re-registration is not furnished to him by both parents, unless—
(a) the name of a person acknowledging himself to be the father of the legitimated person has been entered in the register in pursuance of section seven of the Births and Deaths Registration Act, 1880, or
(b) the paternity of the legitimated person has been established by an affiliation order or otherwise by a decree of a court of competent jurisdiction ; or
(c) a declaration of the legitimacy of the legitimated person has been made under the Legitimacy Declaration Act, 1858, as amended by this Act.

6.—This schedule shall be construed as one with the Births and Deaths Registration Acts, 1863 to 1880.

I move amendment 11:—

(i) Clause 1, page 4, line 55, to delete the word "Registrar-General" and substitute the words " Registrar-General of Births and Deaths in Ireland (in this Schedule referred to as the Registrar-General) " and to delete the hyphen in the expression " Registrar-General " wherever that expression occurs in the Schedule.

(ii) In clause 1, page 4, line 58, after the word " Registration " to insert in brackets the word " (Ireland)."

(iii) In clause 1, page 5, line 8, after the word " Act " to insert in brackets the word " (Ireland)."

(iv) In clause 1, page 5, line 14, to delete the figure " 1858 " and substitute the word and figures " (Ireland), 1868."

(v) In clause 6, page 5, line 47, after the word " Registration " to insert in brackets the word " (Ireland)."

There is the question of the fee at the bottom. I do not know whether that will require a financial resolution. It is a very small matter, and it deals with a small section of the people concerned. If there is a desire to drop it, we could do so, but possibly there may be a desire to introduce a financial resolution.

We cannot do anything with it now, but, if necessary, the matter may be raised on the Report Stage.
