SECTION 44.

I move amendment No. 134:

In page 35, subsection (4), line 33, to delete "No. person" and substitute "Save as is provided for in section 52, no person".

This is a drafting amendment which makes it clear that there is no conflict between section 44(4) and section 52. Section 44(4) prohibits any development of land which would lead to direct access onto a motorway, a busway or a protected road which on the face of it would prevent access, for example, from a motorway service area to a motorway. This amendment makes it clear that this is not the case.

If an industry was established on a motorway, would they get access?

One may gain access from a side road which ultimately leads onto a motorway, but may not gain direct access from the motorway.
