Wednesday, 10 Apr 1935

SECTION 77.

(2) If two panels only are required under the immediately preceding section to be prepared in any election year, the following provisions shall have effect, that is to say :—
(a) if such panels are a panel of large curers and a panel of medium curers, the Minister shall, as soon as may be after the preparation of such panels, make an order (in this Part of this Act also referred to as an ordinary members (election) order) declaring that of the seven ordinary members
(i) such number as may be specified in such order shall be elected by the persons whose names are entered in such panel of large curers at a meeting of such persons to be held on the date in such election year specified in that behalf in such order, and
(ii) the remainder shall be elected by persons whose names are entered in such panel of medium curers at a meeting of such persons to be held on the date in such election year specified in that behalf in such order;
The following amendments were in the name of Deputy Dillon :—
46. In sub-section (2) (a) (i), line 28, after the words " such number " to insert the words " of persons whose names appear upon the panel of large curers ".
47. In sub-section (2), paragraph (a) (ii), line 34, after the words " the remainder " to insert the words " being persons whose names appear on the panel of medium curers ".

It seems to me that Section 77, in its original form, would have entitled the panel of large curers to elect three chimney sweeps.

Minister for Agriculture

So it would.

Is that intended ?

Minister for Agriculture

I do not think they would but I do not see why you should prevent them if they want to do it. I think it is very unlikely that the large curers would elect anybody but the very best persons. They may want their secretary or one of their members who may be considered a good person to represent them. There is a difficulty in the wording of Deputy Dillon's amendment. Apart from the wording, I do not think it is necessary. I think we should leave it to themselves. At times they may consider it best to have their legal adviser as their representative. I do not see why they should be prevented if they want it.

Amendments, by leave, withdrawn.
Section 77 put and agreed to.
