SECTION 92.

(2) Every question in relation to the making of an order to which this sub-section applies arising at a meeting of the Board shall be determined in accordance with the following provisions, that is to say :—
This sub-section applies to—
(a) a cold-storage order ;
(b) an order amending a cold-storage order.
(3) The following provisions shall have effect in relation to any order to which this sub-section applies which the Board are required by this Part of this Act to make at a particular meeting of the Board, that is to say :—
(a) if no ordinary members attend such meeting the Chairman shall make such order and such order as so made by the Chairman shall be deemed for the purposes of this Act to have been duly made by the Board at such meeting;
(b) if any ordinary members attend such meeting the following provisions shall have effect, that is to say :—
(i) in case all such ordinary members pass unanimously a resolution in favour of the making of such order in terms specified in such resolution, such order shall be deemed for the purposes of this Act to have been duly made in such terms by the Board at such meeting, and
(ii) in any other case, the Chairman shall make such order, and such order as so made by the Chairman shall be deemed for the purposes of this Act to have been duly made by the Board at such meeting.
This sub-section applies to—
(a) a production order;
(b) an allocation (production quota) order;
(c) a home-sales order ;
(d) an allocation (sales quota) order.

I move amendments Nos. 71, 72 and 75 :—

71. In sub-section (2), page 44, to delete lines 26 and 27, and to substitute the following :—

(a) a home-sales order ;

(b) an allocation (sales quota) order ;

(c) a cold-storage order ;

(d) an order amending a cold-storage order ;

(e) a purchase order ;

(f) an order making regulations fixing the prescribed sum for the purposes of the provisions of this Part of this Act relating to levy in respect of carcases used for the production of bacon.

72. In sub-section (3), page 44, lines 29 and 30, to delete the said lines and substitute the words " the making of a production order or an allocation (production quota) order at a meeting."

75. In sub-section (3), page 44, to delete lines 50, 51, 52, 53 and 54.

As Deputies will see sub-section (2) relates to matters that the Board may or may not do, and sub-section (3) relates to matters that the Board must do. Apart from that, the chairman has certain powers under each sub-section. Under these amendments we are bringing up into sub-section (2) a home-sales order and an allocation (sales quota) order. We leave in a cold storage order and an order amending a cold storage order, and we add two new matters that were not in the section as it stood. They come under (e) and (f). The purchase order is a new idea. It is new matter in this Bill. There were a good many questions raised from time to time after the Bill was published about the matter of the compulsory purchase order. That comes in where a curer is accused of holding up bacon unnecessarily and not selling it. The trade themselves are very anxious that that should be brought in here and dealt with in this particular section (f)—" an order making regulations fixing the prescribed sum for the purposes of the provisions of this Part of this Act relating to levy." That is a matter that will be discussed in fuller detail later on.

Amendments Nos. 71, 72 and 75 put and agreed to.
The following amendments were in the name of Deputy Dillon :—
73. In sub-section (3) (a), line 32, after the words " if no ordinary members " to insert the words " or only one member."
74. In sub-section (3) (b), line 37, to delete the words " if any ordinary members " and substitute therefor the words " if more than one ordinary member."

I think amendments Nos. 73 and 74 go together.

I think some such amendment is necessary.

Then I withdraw them on the understanding that the Minister will look into them between this and the Report Stage.

No. 76 I am afraid is meaningless as it stands. Amendment No. 75 has more or less disposed of it.
