SECTION 116.

Notwithstanding anything contained in any other enactment or any order or regulation made under any enactment all fines imposed for an offence under any section contained in this Part of this Act shall be paid to the Board.

Minister for Agriculture

I want this section deleted. I have been told that the Minister for Justice has an Act known as the Court Officers Act and under that all fines must be paid into the Department of Justice. Subsequently, they are transferred to the different Departments entitled to them. I believe that was enacted in 1923 or 1924 and it is a very useful Act because the Department of Justice is able to keep a very strict check upon all fines and to prevent embezzlements, whereas if there were a number of different people collecting these fines it would be much more difficult to keep a proper check. We are satisfied the Department of Justice will immediately send to our Department all the sums with which we are concerned. I am moving, therefore, to delete this section.

If it is deleted by what authority would the Department of Justice pay over these fines to the Bacon Board ?

They have power under the Court Officers Act, as I have said.
