SECTION 38.

Question proposed: " That section 38 stand part of the Bill."

This complements the " night hunting " provisions in section 37 by prohibiting the " lamping " of protected wild birds and wild animals. The use of lights and other dazzling devices is a common practice of poachers and unscrupulous traders in uncommon species, e.g. hawks and falcons. The taking of deer, after attracting and dazzling them with the headlights of motor cars, is a source of frequent complaint by legitimate hunters and conservation bodies. The only exemptions from this ban are (a) bird ringing, sometimes carried out at night, and (b) scientific research, and so on. I think this is a section which will appeal to Deputies as being reasonable.

It is superfluous in the previous section. A slight addition would cover the two. They both refer to hunting at night. A magnifying glass might be used in daylight for reflecting. It is really referring to night hunting.

This deals with hunting by certain means which are indicated.

Section 37 deals with hunting by night and section 38 deals with hunting by specific means, or instruments and devices which could be used during the day and certainly could be used before night, as defined.

I doubt if torches or lights could be used during the day for hunting birds. At night they might be used as reflecting mirrors.
