206 Mr. Murphy asked the Minister for the Environment, Heritage and Local Government if the Local Government Acts 1996 and 2001 will be amended to allow local authorities to enact by-laws to prevent the drinking of alcohol in parks owned by community councils. [10131/04]
View answerI understand that a number of local authorities have used their general by-law making powers under the local government code to prohibit the drinking of alcohol in local parks or public open spaces. It may be, however, that significant further extension of this type of regulatory control should best be addressed in the context of public order legislation which is the responsibility of my colleague, the Minister for Justice, Equality and Law Reform. My Department will accordingly raise the issue with that Department.
