178 Ms O. Mitchell asked the Minister for the Environment, Heritage and Local Government the position in respect of the taking in charge of estates built prior to the planning Acts in 1963; if legislation requiring local authorities to take them in charge is envisaged; and if he will make a statement on the matter. Estates built prior to the commencement of planning legislation in 1964 may be taken in charge in accordance with the provisions set out in section 11 of the Roads Act 1993. Section 180 of the Planning and Development Act 2000 provides for an updated framework in relation to the taking in charge of housing estates for which permission has been granted under the 2000 Act or the Local Government (Planning and Development) Act 1963. There is no proposal to amend these provisions.
