274 Mr. Stanton asked the Minister for Education and Science, further to Question No. 236 of 29 June 2004, the number of appeals against expulsion in the post-primary sector and in the primary sector, which were successful in 2003 and in 2004; and if he will make a statement on the matter. In the calendar year 2003, one appeal in relation to permanent exclusion was received at primary level. That appeal was resolved at facilitation and did not proceed to a hearing. At post-primary level there were 34 appeals received in relation to permanent exclusion. Of these four were withdrawn, one was resolved at local level, and nine were resolved at facilitation. Of the remaining 20 appeals, seven were upheld and 13 were not upheld at hearing.

In the period from 1 January to 30 June 2004, there were no appeals in relation to permanent exclusion at primary level. In the same period at post-primary level 28 appeals in relation to permanent exclusion have been received. Of these six were withdrawn, one was resolved at local level, and nine were resolved at facilitation. Of the remaining 12 appeals, three were upheld and nine were not upheld at hearing.
