100 Dr. Upton asked the Minister for Justice, Equality and Law Reform the position in regard to the investigation of an attack allegedly committed by members of the Garda Síochána on a person (details supplied) in County Wicklow which was reported to him earlier in 2004 and in respect of which he sought a report from the Garda Commissioner; and if he will make a statement on the matter. The matter relates to a case where legal proceedings have been initiated against the Garda Commissioner, the Minister for Justice, Equality and Law Reform, Ireland and the Attorney General. Accordingly, it would be inappropriate of me to comment further pending the determination of these proceedings.
