260 Mr. Naughten asked the Minister for Agriculture and Food the reason her Department settled a case in the courts with a company (details supplied), in view of the Department’s vigorous defence of the case during the nine week hearing; the total liability to the State; the legal cost involved; and if she will make a statement on the matter. The case in question was settled without any admission of liability, on the advice of senior counsel and with the approval of the office of the Attorney General. The settlement details are subject to a confidentiality clause which binds both parties involved. However, the financial details of the settlement will be open to scrutiny in the same way as all other expenditure of funds by my Department.

I can say that no costs have been determined as yet and they will in due course be subject to taxation before the taxing master.
